Clancy jury sent home after day 6; judge refuses to dump holdout juror

PLYMOUTH, Mass. — The Lindsay Clancy murder jury went home Thursday, Sept. 3, 2026, after a sixth day of deliberations with no verdict. Judge William F. Sullivan sent the panel out just after 4 p.m. and ordered them back Friday at 9 a.m., CBS Boston and the Associated Press reported.

Earlier Thursday afternoon the foreperson told the court that one juror would not follow the court’s instructions on reasonable doubt. Sullivan spoke with jurors one by one, re-read the reasonable-doubt charge in open court, and sent the panel back to deliberate. Defense attorney Kevin Reddington then moved to remove that juror, saying the foreperson’s note showed “one juror who refuses to listen to the law that you have given him or her on reasonable doubt.”

“If we come back in a half hour with a mistrial because of a juror that has just spurned the instructions of this court, it’s a shame. It’s a real shame,” Reddington said, according to CBS Boston. Sullivan refused. “I don’t feel it is proper for me to side with one side or the other of the deliberations. I don’t feel it’s appropriate for me to say I agree with one juror or 11,” he said, per the AP. Prosecutor Jennifer Sprague argued there was no clean way to decide who was right inside a sealed jury room.

The nine women and three men have twice told Sullivan they are deadlocked — Tuesday and again Wednesday — after which he delivered a Tuey-Rodriguez “dynamite” charge urging a last serious try without abandoning honest convictions. Clancy, 36, does not deny strangling her children — Cora, 5; Dawson, 3; and Callan, 8 months — in their Duxbury home on Jan. 24, 2023. Her defense says postpartum psychosis and overmedication wiped out criminal responsibility; prosecutors say she knew what she was doing. Jurors can choose first-degree murder, second-degree murder, manslaughter, not guilty, or not guilty by reason of insanity. Day seven starts Friday morning.
