PLYMOUTH, Mass. — Lindsay Clancy has added veteran Boston attorney Martin Weinberg — who previously fought a double-jeopardy challenge for Karen Read after her 2024 mistrial — to pursue dismissal of her murder case on double-jeopardy grounds after a Sept. 4 mistrial, Fox News reported Tuesday, Sept. 15, 2026.

Weinberg entered a limited appearance Tuesday to file and argue a forthcoming dismissal motion and “related matters,” according to a Plymouth Superior Court filing obtained by Fox News Digital. The filing does not say when the motion will be submitted. Clancy’s next scheduled court date is Sept. 29.

Plymouth Superior Court Judge William Sullivan declared a mistrial Sept. 4 after jurors deliberated seven days without a unanimous verdict. Several jurors later said the panel split 11–1 in favor of finding Clancy not guilty by reason of lack of criminal responsibility, with one juror voting to convict, Fox News reported.

Longtime defense attorney Kevin Reddington signaled after the mistrial that he would fight any retrial. Prosecutors can generally retry a defendant after a hung jury, but Clancy’s team is expected to argue the circumstances of this mistrial make a second trial improper. Weinberg mounted a similar fight for Read after her 2024 trial ended without a verdict; a judge rejected that bid, finding the jury never formally returned not-guilty verdicts and that counsel had agreed to the mistrial — Read was later retried in 2025, Fox News recounted.

Clancy is accused of strangling her three children — Cora, 5; Dawson, 3; and 8-month-old Callan — in the family’s Duxbury home in January 2023, then jumping from a second-story window in an apparent suicide attempt that left her paralyzed, authorities have said. She does not deny the killings but pleaded not guilty, with the defense arguing postpartum psychosis and heavy medication left her not criminally responsible; prosecutors say she planned the attack after sending her husband out of the house. She remains in custody at Tewksbury Hospital. Prosecutors have not publicly announced whether they intend to retry her.
